Currently prosecuting the claims of major opt-out plaintiffs in the precedent setting LCD price fixing antitrust litigation. The actions are pending in the United States District Court for the Northern District of California as part of a nationwide Multi-District Litigation (MDL) that is one of the largest antitrust cases in the United States history. Collectively, our clients are seeking damages of over $1 billion. The Bilzin Sumberg team has alleged that LCD manufacturers conspired to raise prices and control production capacity of LCD panels in violation of Section 1 of the Sherman Act as well as the California Cartwright Act and the Florida Unfair Deceptive Trade Practices Act. We have not followed the traditional role of counsel to opt-out plaintiffs in large MDL litigations-simply trading the course set by the classes. To the contrary, our team has successfully raised factual and legal issues for the first time in the MDL- - including legal arguments that have never been made before in any antitrust case.
