Eric Singer is a member of Bilzin Sumberg's P3 and Government Contracting team, where he represents both public- and private-sector clients in the areas of government contracting and complex government transactions, including public-private partnerships (P3). Eric has negotiated development agreements for a wide variety of public assets and public-private developments, including transportation infrastructure, transit-oriented development, public buildings, and public utilities, and has represented clients on some of Florida’s most transformative projects. Eric also handles the full spectrum of public-contracting issues, from preparation of proposals through appeals of administrative bid protests. For example, as part of securing a $300-million Metrorail contract for an Italian company, he defended a bid-protest appeal to the Federal Transit Administration.

Eric combines that practical experience with the extensive academic knowledge he gained as a visiting faculty member and research fellow at the New York University School of Law, where he studied P3s across the United States and abroad, in order to further his clients’ goals. Prior to joining Bilzin Sumberg, Eric served as a law clerk to the Honorable Danny J. Boggs of the United States Court of Appeals for the Sixth Circuit.

Q & A
How would you describe your legal approach?

I start by listening - I try hard to fully understand my client's objectives before providing an answer. Next, I take a step back and consider problems from multiple contexts: legal, business, and political. In addition to what is written in an RFP or other solicitation document, I consider other applicable legal requirements, including common-law and federal requirements, my client’s business goals and competitive advantages, and the relevant public-policy and political issues of the day. By recognizing and accounting for all of those issues, I can help craft and execute an effective strategy.

What separates you from other lawyers in your field?

My expertise and skill sets permit me to take more of a soup to nuts approach than is typical for either a government relations lawyer or a transactional lawyer. Being able to operate outside of most attorneys' comfort zones and understand the whole picture works not only to overcome legal challenges, but also to anticipate and take measures to avoid those challenges before they arise.

How did your academic experience shape your current practice?

I was a research fellow at NYU Law School, where I studied public-private partnerships and government contracting, both on a national and international level. Whenever I am presented with a challenge, I am able to attack the issue with a broad knowledge of how others have successfully dealt with the same issues in the past and in other jurisdictions. That kind of understanding allows me to quickly identify potential problems and solutions and safeguard my clients from future risks in P3 agreements.
