A trusted advisor to a roster of domestic and international companies, José is engaged throughout every stage of a client's business dealings, minimizing, and often preventing, the risk of a business dispute down the line.

José possesses a nuanced understanding of international arbitration rules and procedure, and serves as Co-Chair of the Firm's International initiative. A fluent Spanish speaker, José recently participated in international arbitration matters involving parties from India, Peru, Colombia, Argentina, and Venezuela.

How do you provide value for your clients?
I view my job as providing practical advice that considers both the legal and the business risks. I take the time to learn my clients' businesses. I don't just tell my clients what the risks are - I help them make the tough business decisions necessary to succeed. Instead of getting involved once something goes wrong, clients frequently bring me in as they are considering a new business deal. Clients want my perspective as a litigator in order to minimize the risk of a dispute later on, or to place them in the best possible position when a dispute does arise. As a litigator, that kind of prophylactic advice is unusual, but it's extremely valuable for the client.
What differentiates you as an international arbitration lawyer?
I understand that the most important aspect of these cases is being able to reconcile different legal systems, customs and norms. The ability to understand not just the language, dress, and mood of the participants in the room, but also the extent to which cultural norms affect concepts of fairness, patterns of negotiation, or even beliefs regarding the proper method of resolving disputes plays a vital role in the acceptance and successful functioning of international arbitration. Not everyone appreciates such nuances.
What kind of relationship do you like to have with your clients?
I want my clients to view me as a trusted advisor, not just a litigator. If you focus only on the litigation, your relationship ends when the litigation is over. But, if you focus on the client, the relationship will continue to grow.

Obtained a full victory at trial on behalf of Lennar Corporation, one of the nation's leading homebuilders, turning a $30 million fraud and misrepresentation claim against our client into a $14 million victory in our client's favor. Olivia's Savannah, LLC, and its private lender, sued Lennar claiming they had been fraudulently induced to purchase 220 acres of raw land. Our team successfully counterclaimed, obtaining $14 million in defaulted mortgage payments for Lennar and also obtaining a foreclosure judgment that allowed Lennar to recover title to the 220 acres of land.
EXPERIENCE
Representation of the court-appointed equity receiver over Vaccine & Gene Therapy Institute of Florida Corp. ("VGTI"), a non-profit, biomedical research institute established in 2008 with the assistance of a $60 million grant from the State of Florida’s Innovation Incentive Fund intended to anchor and drive the State’s expansion strategy for biomedical research. Construction of VGTI's state-of-the-art research facility in Port St. Lucie was funded by a mortgage loan from the City of Port St. Lucie, which was in turn funded by a $64 million bond issuance. In a general counsel role to the receiver, Bilzin Sumberg assisted in all aspects of the fulfillment of the receiver's duties including investigating the affairs of VGTI, managing and marketing VGTI's real property, and working with stakeholders in order to maximize of the recovery for creditors.
