Catalina is a Staff Associate in the CMBS practice, where she represents CMBS loan servicers in all aspects of CMBS loan servicing, including servicing practices, procedures and standards, and business and legal issues involving pooling and servicing agreements, mezzanine loans, preferred equity, inter-creditor and co-lender agreements, REMIC and rating agency reviews. She also handles loan-servicing files involving loan assumptions, consents to non-permitted equity transfers, partial releases, easements, collateral swaps and redevelopment, cash management, condemnations, loan modifications, deeds in lieu of foreclosure, and other loan workouts.
Q & A
How has your experience working as an assistant public defender shaped the skills you use to serve clients?
My time at the Miami-Dade Office of the Public Defender greatly honed my negotiation skills. Public defenders spend as much time at the negotiating table across from the prosecutor as at court in front of a judge, and on top of that, public defenders and prosecutors often start off from significantly divergent negotiating positions in seeking a compromise. Being an integral part of such high stakes and painstaking negotiations has helped train me as an effective advocate for my clients, who are constantly engaged in transactions like loan workouts and transfers that all hinge on successful negotiation between the parties.
How does your community involvement inform your real estate practice?
I serve on the Board of Directors for the Miami Beach Community Development Corporation, which owns, maintains, and rehabilitates historic affordable housing properties in Miami Beach. Miami Beach’s real estate market is one of the most dynamic in the country, and having the opportunity to advise on real estate transactions that involve a range of local stakeholders in that market exposes me to the gamut of real estate issues that sooner or later will be relevant to a firm client.
