Broiler Chicken Antitrust Litigation for Opt-Out Plaintiffs

Broiler Chicken Antitrust Litigation for Opt-Out Plaintiffs

Representation of a major regional food distribution company in an ongoing case against the major producers of chicken in the United States. The chicken manufacturers- who account for more than 90% of all chicken products sold in the country- participated in a conspiracy nearly a decade long to artificially restrict the output of chicken sold in the United States and thus raise the prices of broiler chickens. The client- one of the top ten food distributors in the country servicing ten states- initiated an independent action against the members of the conspiracy for damages sustained as a result of the overcharges they incurred in connection with their purchases of chicken over the class period.
