Obtained Dismissal of Nationwide Putative Class Action

Representation of a major homebuilder in a nationwide putative class action in which plaintiffs alleged negligence, strict liability, breach of express and implied warranty, and violation of FDUPTA, and sought injunctive relief and medical monitoring, asserting that spray polyurethane foam used as an insulation in the manufactured homes was defective and toxic by both design and installation. Our team successfully prevented the consolidation of the case into an MDL, obtained a stay, and compelled home inspections which revealed a lack of basis in the plaintiffs' claims. The suit was voluntarily dismissed.
