Mindy A. Mora Named Outstanding Member of The Year by The Florida Bar's Business Law Section

Press Release
June 29,2007

Miami, Florida, June 29, 2007  Bilzin Sumberg is pleased to announce that Mindy A. Mora, a Partner in the firm's Restructuring & Bankruptcy Group, received the Outstanding Member of the Year Award from The Florida Bars Business Law Section. The annual award was given in recognition of her exemplary work in the field of business law and unsurpassed contribution of time and talent to the Business Law Section of The Florida Bar since 1995.

Ms. Mora has held several distinguished roles in her efforts to update and streamline Florida bankruptcy law. In giving her the award, The Florida Bar highlighted her recent work in chairing a task force that spearheaded major revisions to Florida's Assignment for the Benefit of Creditors Statute (Chapter 727, Florida Statutes). Those revisions were recently signed into law by Florida Governor Charlie Crist, and take effect July 1, 2007.

"This is a tremendous and well-deserved honor for Mindy," said John C. Sumberg, Managing Partner of Bilzin Sumberg. "Her contributions are rightfully recognized with this award, and all of us at the firm congratulate her for a job very well done."

The legislation resulting from the work of the task force she headed amends Chapter 727 to make assignments for the benefit of creditors a more viable alternative to chapter 7 bankruptcy liquidation for distressed Florida businesses. The new revisions streamline many of the processes involved, and bring about two especially noteworthy changes: first, assets which can be liquidated in an assignment case now clearly include tort claims and causes of action; and second, the defense of malfeasance by an assignor is no longer a valid defense in an action brought by an assignee. These changes are significant because they increase the pool of assets from which creditors may obtain a recovery on their claims.

Ms. Mora's practice focuses on creditors rights, workouts, bankruptcy and commercial loan transactions. She has been featured in The Best Lawyers in America, Chambers USA, Florida Super Lawyers, South Florida Legal Guide Top Lawyers and Florida Trends Legal Elite.
