Brandon Storm is an accomplished litigation attorney with extensive antitrust experience in complex competition matters, both in government and private practice. Brandon is adept in handling a diverse portfolio of matters including merger clearance, class action litigation, CID compliance, FTC rulemaking, and criminal investigations. He has also managed Civil Investigative Demand negotiations with major corporations and deposed senior executives across various industries. 

Before joining Bilzin, Brandon worked at an AmLaw 100 firm where he litigated both class action and business-to-business disputes on both sides of the “v.” at every stage of litigation from initial advising to appeals. As a former trial attorney at the Antitrust Division of the U.S. Department of Justice, Brandon achieved notable successes in high-profile investigations including a variety of mergers, joint ventures, and anticompetitive conduct. During his year detailed to the Appellate Section, Brandon worked on amicus briefs, statements of interest, and memoranda to the Office of the Solicitor General on topics including ancillary restraints, dual distribution arrangements, and the role of anticompetitive intent in Section 1 claims. Brandon’s practice has spanned multiple sectors including financial services, FinTech, banking, healthcare, transportation, food and beverage, and labor markets. Brandon began his legal career clerking for the Honorable Ed Carnes, then Chief Judge of the Eleventh Circuit Court of Appeals.

Q & A
What unique facet of your background is beneficial to clients?

My government experience is a big asset in helping clients address their challenges. While practicing at the Antitrust Division at the Department of Justice, I led big bank merger investigations and worked on headline-grabbing litigation. On the private practice side, I’ve helped clients manage CIDs, subpoenas, depositions and white collar probes from the Department of Justice and the Federal Trade Commission. Consequently, I’m uniquely positioned among local lawyers to advise clients when governmental authorities in DC come knocking for documents or demand appearance in court. This experience also allows me to litigate antitrust class actions more effectively because many of our cases are private actions that grew out of alleged misconduct investigated by the DOJ and FTC. 

What attracted you to Bilzin Sumberg’s Trial and Litigation Practice?

I was drawn to Bilzin Sumberg because of its preeminent and unique antitrust opt-out practice, which is well-known for its effectiveness in recovering more for companies that have been harmed by price fixing and other illegal business practices than they could get by remaining as part of a class action. More generally, the firm’s breadth of litigation experience is deeply impressive- a lot of firms say they have experience on both sides of the ‘v’, but I can count on one hand the number of firms that have the kind of bet-the-company experience as both plaintiffs and defendants in the way that our teams do. That diversity of cases- both across case types and affected industries- makes the work appealing and exciting.
