Defense of Investor Sued by Chapter 7 Trustee for Ponzi Scheme Bankruptcy Estate

Cole, Paul M. and Lisa
Representation of individual good faith lender/investor in the notorious Capitol Investments Ponzi scheme perpetrated by the infamous Nevin Shapiro. As a result of receiving substantial distributions from Capitol, our client was sued by the chapter 7 trustee for the Capitol Investments bankruptcy estate on claims of usury and for receipt of fraudulent transfers as Ponzi scheme "false profits." We negotiated a favorable settlement of less than forty percent of amount trustee sought to recover.
