Counsel to Post-Confirmation Debtors of Medical Supplies Distributor

Official Committee of unsecured creditors or Pharmed Group; Joseph E. Myers as Plan Administrator of The Pharmed Group Estate

Counsel to the post-confirmation debtors and plan administrator in the Pharmed chapter 11 case in the Southern District of Florida. Prior to that role, we advised the official committee of unsecured creditors as they successfully negotiated a plan of liquidation for the debtors, resulting in the appointment of the post-confirmation plan administrator. As counsel to the plan administrator, we sought to recover improper dividends and distributions by commencing a $105 million lawsuit against 11 of the debtors' former directors and officers. We successfully obtained settlements with all 11 defendants, which were approved by the bankruptcy court. Before filing for bankruptcy protection, the Pharmed Group debtors were the largest independent, minority-owned, full-line distributors of medical, surgical, and rehabilitative supplies in the United States. The case has attracted a significant amount of attention in the local business community and media.
