Successful Challenge to North Miami Beach's Height & Density Zoning Ordinance

Representation of claimants in suit against the City of North Miami Beach challenging the City's Height & Density zoning ordinance. Our clients asserted that a 2007 ordinance capping the height of future developments at 15 stories and requiring anyone requesting a variance to obtain a super majority vote of the elected Council breached the City's charter. After hearing our argument, the Circuit Court ruled in our favor, holding that the City of North Miami Beach violated its own charter both by establishing various requirements for a majority of votes and by applying such requirement to the City Council in its entirety. This ruling was a significant victory as it confronted the Hometown Democracy movement in South Florida.
