Prosecution of bank’s wrongful dishonor action

Represented the plaintiff, All American Semiconductor, Inc., a national electronics distribution company, in the prosecution of a wrongful dishonor action against the defendant, Wells Fargo Minnesota, NA. The action involved the issuance of a letter of credit by Wells Fargo in favor of All American, and raised a number of issues of fact impression regarding the standards applicable to letters of credit in the United States District Court for the District of Minnesota and the Eighth Circuit. Bilzin Sumberg obtained a summary judgment for all amounts claimed by All American and was able to sustain the judgment in favor of All American on appeal to the Eighth Circuit. The case stands as one of the most important decisions on the law of letters of credit in the Eighth Circuit.
