Representation of Alexander Montessori School in connection with a public hearing application to seek modification of a previous site plan approval in order to expand student enrollment from 270 students to 329 students at the school's campus in the Village of Palmetto Bay. Bilzin Sumberg successfully handled the request for a modification as well as the application for public hearing. The application unanimously passed 5-0. However, a Charter Amendment approved by the Village requires 75 percent of the voters within 2,000 feet of a private school to approve school enrollment expansions. After Alexander fell short in votes in 2013 (66 percent) and 2015 (70 percent), Bilzin Sumberg challenged the constitutionality of the Charter Amendment in 2016 and won on behalf of Alexander. The case has been appealed to Third District Court of Appeal. The school received Village approval to increase student enrollment from 270 to 329 but must await the Third DCA ruling before the approval of the public hearing is considered final.
