Brian has acquired expansive knowledge about land use, zoning and the development process in South Florida, with a particular emphasis in Miami-Dade County and its numerous municipalities. For over twenty years, Brian has built solid working relationships with municipal and county government staff and officials at various levels as he has guided developers and property owners others through local regulations and processes. 

In addition to his traditional land use and zoning practice, Brian also has extensive experience in drafting zoning opinion letters for lenders, entitlement and acquisition due diligence memoranda for clients, as well as experience assisting clients in permitting, platting, water and sewer, and environmental matters.

What distinguishes you as a land use attorney?
I am tenacious and I do not give up easily.  I know how to quickly locate and evaluate historic approvals, deeds and plans, and I explore every avenue to establish the foundation for success.

I have developed local knowledge in dozens of jurisdictions across South Florida. Importantly, I understand each jurisdiction's unique regulations and codes and also how staff and officials have historically interpreted them.  For example, one client initially was denied permission to set up a particular use in an industrial area.  I researched decades of approvals to produce examples of how such uses historically were allowed in that particular district.  Based on these results, our client was able to proceed directly to permit and avoid the costly and time consuming public hearing process. 

I also have developed knowledge in the various developer-related disciplines, including building, planning, zoning, platting, community development, water and sewer and public works.  My relationships with government officials span over two decades, when I was first starting my practice.  Many of today's supervisors and government officials were also just starting out in government at the time I began my practice and are now directors and department heads.  We have grown our careers alongside each other.
How do new rules affect your clients?
New regulations are often proposed or adopted that, while well-intentioned, may have unintended consequences for development. Workforce housing requirements, LEED certification, provisions to address rising sea levels, and art in public places may all be laudable or desirable goals.  However, implementing such mandatory requirements can have counter-balancing effects, and developers and property owners must therefore factor in the cost of compliance. I work hard to keep my clients informed of changes in the development industry and laws that affect their particular area of development, and I have in the past successfully lobbied for key changes or exceptions from the most onerous requirements.
