Defended a major homebuilder in a dispute with a joint venture partner alleging breach of contract, breach of guaranty, breach of fiduciary duty, fraud, fraudulent transfer and conversion. The plaintiffs also invoked a "clawback provision" in the partnership agreement to recover funds that were distributed to our client in anticipation of the success of their venture.
