We assist clients with pre-acquisition due diligence, acquisitions and dispositions, formation of joint ventures, financing, land use and zoning, drafting and negotiation of all manner of business contracts, and myriad other issues that can arise in the course of their businesses. We also provide counsel to subsidiaries of homebuilders in matters related to mortgages, title insurance and other financial services.

Our team handles complex litigation and arbitration for homebuilding industry leaders when disputes arise, including class actions, breach of contract claims, defense of mortgage loan repurchase and indemnification claims, and construction defect claims.

Increasingly, issues involving data security for owners and contractors have come to the fore as the rise of "smart systems" for everything from lighting and telecommunications or home WiFi and other utilities creates potential areas of legal exposure for the providers of such products and services, especially as to storage of personal data.Our attorneys assist clients in navigating the complex data privacy issues that have arisen concomitantly with the modern home and office.

Bilzin Sumberg's robust Environmental team counsels homebuilders across the United States in environmental matters throughout the life cycle of a development. This includes handling pre-acquisition environmental due diligence, site assessment and remediation, permitting at the local, state and federal levels, compliance and enforcement defense. The firm's strength lies in its ability to counsel clients on the most appropriate and cost-effective environmental remediation strategy for avoiding unwelcome litigation and penalties. The firm's attorneys also possess extensive experience in advising clients on redevelopment plans and strategies, frequently counseling developers seeking to repurpose golf courses, landfills, agricultural lands and other real estate that may have residual contamination issues.
