Bilzin Sumberg's public infrastructure lawyers provide legal counsel and advocacy for concessionaires, lenders, developers, contractors, and governmental agencies across a broad range of infrastructure sectors, including high-speed rail, airports, water and sewer, port facilities, convention centers, courthouses and other government buildings, parking facilities, and solid waste management facilities.  Bilzin Sumberg’s expertise includes multiple methods of project delivery, including design-build projects and privately-financed public-private partnerships (“P3”).

Increasingly designed, financed, built, and managed through public-private partnerships, public infrastructure projects throughout the United States have seen a surge in popularity over the past decade. P3s offer governments the ability to achieve more efficient projects by sharing risk and responsibilities with non-governmental bodies. P3 arrangements are long-term and therefore it is imperative to work with counsel that have a high degree of experience, knowledge, and business acumen to assist clients in achieving optimal results and objectives.

Bilzin Sumberg's attorneys have been instrumental in some of Florida’s largest and most innovative public infrastructure projects, including the $5 billion ocean outfall contract with Miami-Dade County and the $2.4 billion high-speed rail from Miami to Orlando. The blend of the firm's project finance and P3 experience coupled with its real estate, construction, land use and zoning, joint venture, and finance teams offers clients a unique perspective that is often critical in establishing properly aligned incentives foundational to public infrastructure projects.

The firm's representation of public and private sector clients spans the life cycle of public infrastructure projects, including:

  • Project Development & Finance - including complex funding strategies and project delivery methods, such as Design-Build-Finance-Operate-Maintain (DBFOM) P3 Projects. Bilzin Sumberg serves as lead consortium counsel on a variety of DBFOM projects across multiple asset classes.

  • Government Contracting & Procurement, including bid protests.

  •  Construction, Design & Operation - including construction contracts, regulatory compliance related to public funding and public land; Design/build JV agreements; and dispute resolution such as construction litigation.  Bilzin Sumberg also serves as D-B JV counsel on P3 projects.
